Upon submission of any application forms at IDYLLWILD GENIE SERVICE websites:-
You acknowledge that you have fully read, understood and agreed with the terms & conditions stated herein .
You agree to provide and maintain accurate, complete and updated information to IDYLLWILD GENIE SERVICE.
You acknowledge that due to the internet transparent rules, some of your contact information will be attached to your domain(s) and will therefore become publicly available through WHOIS lookup .
You understood that all payment must be paid in advance before any request to our services can be processed and that the amount paid will not be refunded.  

Your use of the service is solely at your risk. IDYLLWILD GENIE SERVICE is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

IDYLLWILD GENIE SERVICE makes no warranties of any kind for the services being offered. The service is provided on an "as is" and "as available" basis. No advice or information given by IDYLLWILD GENIE SERVICE shall create a warranty.

We provide no warranty that the service will be uninterrupted or error-free. We assume no liability, expressed or implied, for any downtime for any reason.

You agree to indemnify, defend and hold harmless IDYLLWILD GENIE SERVICE from any and all liabilities, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting directly and/or indirectly from your use of the service which damages either you, IDYLLWILD GENIE SERVICE or any other party or parties without limitation or exception.

We reserve the right to decline the registration or domain forwarding of adult-oriented domains and to revoke without refund any services which we, in our sole judgment, deem are being used for any unlawful purposes, or to promote adult-oriented or "offensive" material, or as a source of unsolicited bulk email, or as an address to use for replying to unsolicited bulk email, or in a manner injurious to our customers, their reputation or the business reputation of the IDYLLWILD GENIE SERVICE communities.

BACKUP: The user is responsible for keeping a complete and current copy of Web site files as backup on a remote system (not on IDYLLWILD GENIE SERVICE servers). IDYLLWILD GENIE SERVICE is not responsible for any lost files, information or data. Our backup tapes are for backing up our system configurations and databases and are NOT for keeping backups of client Web sites. IDYLLWILD GENIE SERVICE does not guarantee to possess the most current copy of a your Web site.

MAINTENANCE: The user is responsible for providing accurate and current information for his website. IDYLLWILD GENIE SERVICE does not provide free update service unless on user's demand, and you agree that in such cases one time maintenance fee or monthly maintenance fee will be imposed depending on the maintenance frequency. 

DATA TRANSFER: IDYLLWILD GENIE SERVICE provides the limited monthly data transfer depending on web space or web traffic allocation specified in our hosting web page. If at any time the Customer’s website generates bandwidth usage over the allocated limit, you will need to switch to a higher plan in order to cope with the heavy traffic. If the customer cannot meet this agreement, IDYLLWILD GENIE SERVICE reserves the full right to terminate the account without notice.

FILES DISTRIBUTION: You are not permitted to have any commercially available software, fixes, patches or electronic media (i.e. MP3, WAV, MPG etc.) for download on your site. Any violation of this term may render an account liable to service termination at our discretion.

ILLEGAL ACTIVITIES: including but not limited to storing and/or distributing illegal copies of copyright software, hosting/maintaining inappropriate sites, violating trademarks and copyrights, violating Indian & International laws, selling and/or distributing illegal contraband.

INTERNET ABUSE: including but not limited to: spamming - mass unsolicited emailing, posting obscene or inflammatory messages, nudity, threatening other Internet users, and spamming our support staff. Any adult content will be put off the web server as and when or system notices and the client's account will be terminated without any refunds.

RENEWAL: You must pay the hosting renewal fee in advance to continuously parked your website on our web server.

PACKAGE: The package to choose will depends on the size and complexity of your request and the number of images. All packages come with free submission to search engines. There will be no discount even though you have registered a domain name somewhere else. Website not hosted with us is not entitled to any free features.

PRICING: All package pricing is true only if the page layout is chosen from our pre-designed templates and your website is hosted on our server. Any additional request will incur additional charges. All basic pricing quoted is not final until the design and has finished and you have no more request. Note that pricing does not include site maintenance or updating fee and other general fees like postal fee for sending materials if any.

COPYRIGHTS: Any pre-designed web page layouts are holding free licenses and not copyrighted to any client. The client shall not make any claims or disputes to any parties for their web page similarity. We are not responsible and do not provide guarantee for any of these layout being used infinite number of times. We reserve the right to print our name and provide a link to our website at the very bottom of every pre-designed web pages.

CUSTOM DESIGN: Web layout can be tailor designed to the customer's demand with different pricing structure. The client can copyright the custom designed web page to prevent re-use.

DEPOSIT/PAYMENT: A deposit of 50% of the estimated price must be made before the design work proceeds and non-refundable. The balanced plus any additional cost result from your request to be settled fully within 5 working days from the date of confirmation, failing which the web pages concerned will be suspended from publishing on the net.

MAINTENANCE & UPDATING: Upon completion of your web pages, you will be given 3 working days for confirmation. Auto-confirmation will resume if we receive no reply after the third day. Once the web pages are confirmed accepted, any amendment, updating or insertion to the existing web page due to whatsoever reasons thereafter will incur service charge, which will depend on the amount of work to be done.

COMPLETION: We do not guarantee on the completion date. It may vary from 5 working days to 30 working days or more. No claims on delay will be entertained.

Spamming

Spam is a term by the internet community to describe the unwanted delivery of unsolicited and/or bulk and/or communication done through newsgroup messages. We do whatever we can to prevent the sending of unsolicited bulk email messages. If you intend to use our services to spam the Internet community, please do not register with us. Payment & Billing

All pricing is guaranteed for the term of pre-payment. IDYLLWILD GENIE SERVICE reserves the right to change prices at any time, unless other terms have been agreed upon.

You agree to pay the amount in United States Dollars for the particular service(s) chosen, via the payment methods specified hereunder, according to the pricing displayed unless the particular service chosen is indicated "free" in the pricing list

All services are billed in advance. All payments must be via check, money order or post order payable to IDYLLWILD GENIE SERVICE. All payment must be posted to our company address at P.O. Box 278 - Mountain Center, California -92561. Orders will not be processed until the payment is cleared by bank or post office . We cannot be held responsible for delay in processing due to any of these reasons: Postal delay, check rejected, postal lost or insufficient payment.

In case of ordering website design package, your understand that the deposit (50% of the estimated cost) must be paid before we can proceed to design your web pages.

For renewal, we must receive payment and have it cleared by bank or post office before the renewal date. We will not be responsible for maintaining your site content or domain names beyond the renewal date. It is solely your responsibility to renew your domain name and web hosting plan before the due date. Reminder notice will be sent to you via email 60 days prior to the due date, but we do not guarantee on the receipt of the notice by you for any reasons. If, for any reason, you do not contact us and/or fail to pay renewal fees when due, we have the right to immediately cancel all hosted pages for which payment was not received and your hosted sites with IDYLLWILD GENIE SERVICE without further notice to you. We reserve the right to adjust our registration and renewal fees prospectively upon fifteen (15) calendar days prior notice.

Any site which has been canceled for non-payment or non-renewal will have to be re-ordered as a new account . You may upgrade your hosting plan at any time by emailing us at info@idyllwildgenieservice.com or by mailing us at P.O. Box 278 - Mountain Center, California -92561 or by phone (951) 659 -6174.

All sales are final. There are no refunds (include the deposit) on any services ordered by you unless it is due to the direct result of the IDYLLWILD GENIE SERVICE failing to comply to the terms of our services offer. The amount refunded for such a special case may not be full.
